Why Hazardous Waste Requires Special Handling

 

 

Regulatory agencies, such as the Environmental Protection Agency (EPA), the California Department of Toxic Substances Control (DTSC) and other state environmental departments, have strict guidelines on how hazardous waste should be handled, transported, and disposed of to prevent these risks.

 

In December 2024, California Attorney General Rob Bonta announced a $3.5 million settlement with Frontier California Inc. for the illegal disposal and mismanagement of hazardous waste. The settlement requires Frontier to pay penalties and implement significant changes to its operations to comply with state law.

 

Another notable case involves Macy's Retail Holdings, LLC, which was ordered to pay $1.6 million in civil penalties and costs due to violations of environmental laws. The lawsuit alleged that Macy's unlawfully disposed of hazardous waste at its 98 California retail locations over several years.

 

Failure to properly handle hazardous waste can also have serious health implications. Exposure to hazardous substances can cause respiratory problems, chemical burns, organ damage, and even cancer. Workers who handle hazardous waste without proper training and protective equipment are at significant risk. Companies must invest in proper waste management training and safety protocols to protect employees and the surrounding community.



Proper Disposal and Transport Regulations

 

 

Different types of hazardous waste require different disposal methods, and not all disposal companies are equipped to handle every type of hazardous waste. 

 

Proper transportation is a key aspect of compliance, as different waste types have unique requirements for containment and disposal.

 

For instance, biomedical waste is a highly regulated category of hazardous waste, particularly in California. The California Department of Public Health (CDPH) oversees medical waste transporters. Even though biomedical waste is considered hazardous, a hazardous waste transporter licensed only through the Department of Toxic Substances Control (DTSC) cannot legally transport it unless they also hold a CDPH license. This regulatory distinction ensures that hazardous waste is handled by appropriately trained professionals, minimizing risks to public health and the environment.

 

Certain types of hazardous waste require specific disposal methods as well. For example:

 

  • Chemical waste often needs to be neutralized or treated before disposal to prevent environmental contamination.
  • Electronic waste must be dismantled, with hazardous components safely extracted and disposed of.
  • Pharmaceutical waste may require incineration to ensure that harmful substances do not enter the water supply.
  • Industrial waste may be recycled, treated or securely landfilled depending on its chemical composition.

 

Understanding these distinctions is crucial when selecting a hazardous waste disposal partner. Many companies assume that any hazardous waste disposal company can handle all types of waste, but that is not true. Businesses must carefully verify that their waste disposal provider has the necessary permits and expertise to handle their specific waste streams.
